Terms of service

These terms govern use of app.gulfmachineryexchange.com and the GME app, operated by Gulf Machinery Exchange LLC ("GME"). By creating an account, listing, bidding, offering or committing to a deal you agree to them. Effective November 3, 2026.

1. The service

GME is a marketplace that connects sellers and buyers of heavy equipment and provides condition reports, value estimates, escrow, transport coordination and optional protection plans. GME is not the seller of listed machines unless a listing says so. Estimates and AI-generated condition reports are informational; the seller is responsible for the accuracy of a listing.

2. Accounts

You must be 18 or older and authorized to act for your business. Keep your sign-in private; you are responsible for activity on your account. Buyers and sellers appear to each other as anonymous aliases until both commit to a deal, after which names and contact details are shared to complete it.

3. Listings, bids and offers

• Sellers must own the machine or have authority to sell it, disclose known defects and liens, and list an accurate serial number.
• Bids and buy-now commitments are binding. Auctions may be extended by five minutes after a late bid. A seller may set a reserve; a lot does not sell below it.
• Offers, including trades, are binding once accepted and both parties commit. Withdrawing after commitment may incur the fees that would have been due.

4. Fees and payment

There are no listing fees. Sellers pay a success fee and buyers a buyer fee at closing as shown on the fee schedule at the time of commitment. Fees are invoiced through GME and payable by card or bank transfer. Purchase funds are held in escrow and released to the seller after delivery and the end of the inspection window.

5. As-Described Guarantee and claims

A buyer has 48 hours after delivery to report that a machine materially differs from its listing and condition report. GME reviews the claim with both parties and may adjust the price, cancel the deal and refund escrow, or release funds. GME's decision on a claim is final as between the parties for purposes of escrow release; it does not limit other legal remedies.

6. Transport, protection plans and third parties

Carriers quote and perform transport under their own terms; GME coordinates but does not carry. Protection plans are provided by the named partner under its contract. Payments are processed by Stripe under its terms.

7. Prohibited conduct

No shill bidding, misrepresentation, contacting the other party outside GME to avoid fees, listing stolen or encumbered equipment without disclosure, scraping, or interfering with the service. GME may suspend accounts that break these terms and keep fees owed.

8. Liability

GME provides the service as is. To the extent allowed by law, GME's total liability for any claim relating to a deal is limited to the fees GME received for that deal. GME is not liable for indirect or consequential losses, equipment downtime or lost profits.

9. Governing law

These terms are governed by the laws of the State of Florida. Disputes are brought in the state or federal courts in Hillsborough County, Florida, after a good-faith attempt to resolve them with GME.
